1.What these terms cover

These terms set out the conditions on which Affinity Search Partners makes this website available. They apply to every page on this site and to anyone who visits it. By opening or using the site you accept these terms. If you do not accept them, the remedy is simple: do not use the site.

Our privacy policy explains how we handle information about people, both on this site and in our business correspondence, and forms part of these terms.

2.What this website is

This site describes the recruiting services of Affinity Search Partners in general terms for business readers. Nothing on it is an offer to provide services, a quotation, or a commitment to take on a particular search. We provide services only under a written agreement signed by both the client and us. Where anything on this site differs from such an agreement, the signed agreement governs.

3.Emails we send to businesses

As part of our work we may send email to professionals whose roles relate to the services we provide. A person who does not want to receive these emails can stop them by replying to any one of them and saying so. Our privacy policy describes how we choose who to contact, what we hold about them, and how we honor a request to stop.

4.Samples and illustrations

Any board, chart, checklist, table, figure or number that appears on this site, or in a sample document the site links to, is there to illustrate how we work. Such material is sample data. It does not describe the results of any client engagement, and it is not a promise or prediction of the outcome of any search we may run for you.

5.Using the site properly

Rights in any work we perform for a client, including candidate profiles and search materials, are governed by the written agreement for that engagement and not by these terms.

7.Links and outside services

This site links to our main website and to the contact form there. It also loads a typeface from Google Fonts, an outside service. Those sites and services have their own terms and privacy practices, which apply when you use them. We do not control them and are not responsible for their content or conduct.

8.No warranties

This site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the site will be available without interruption, that it will be free of errors, or that any information on it is complete or current. Nothing on this site is professional, legal, financial or employment advice, and you should not rely on it as such.

9.Limits on our liability

To the fullest extent the law allows, Affinity Search Partners and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunities, arising out of or connected with your use of this site, however caused and under any theory of liability.

Our total liability for all claims relating to this site, taken together, will not exceed one hundred US dollars.

10.Your responsibility for misuse

If you misuse this site or breach these terms, you agree to indemnify Affinity Search Partners and its owners, employees and agents against any claims, losses, liabilities and expenses that result, including reasonable attorneys' fees, and to hold us harmless from them.

11.Tennessee law and arbitration

These terms and any dispute arising from them or from your use of this site are governed by the laws of the State of Tennessee, without regard to its conflict of law rules.

Any dispute that cannot be resolved between us informally will be settled by binding arbitration held in Williamson County, Tennessee, under the rules of the American Arbitration Association then in effect. The arbitrator's decision may be entered as a judgment in any court with jurisdiction. This requirement to arbitrate applies except where the law does not allow it, in which case the courts located in Williamson County, Tennessee will have exclusive jurisdiction.

12.General provisions

If any part of these terms is found to be unenforceable, that part will be applied to the extent permitted and the rest of the terms will continue in force. If we do not enforce a provision on one occasion, that is not a waiver of our right to enforce it later.

These terms, together with the privacy policy, are the entire agreement between you and us about the use of this site. We may revise them from time to time. A revised version takes effect when it is posted here with a new date at the top, and your continued use of the site after that date means you accept the revision.
